1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the website at www.pearlydentalcare.com (the “Site”) and any related services offered by Pearly White Dental (“we,” “us,” the “Practice”). By using the Site, booking an appointment, submitting forms, or otherwise engaging with us, you agree to these Terms. If you do not agree, do not use the Site.

Site content is for general informational purposes and is not a substitute for professional dental or medical advice, diagnosis, or treatment. In an emergency, call 911 or seek emergency care immediately.

3. Appointments & Cancellations

Schedule, modify, or cancel by calling (408) 774-1200. We may send confirmations and reminders by email or SMS; message and data rates may apply. Reply STOP to opt out. Missed or late-cancelled appointments may incur a fee per our office policy.

4. Treatment Plans, Estimates & Insurance

Plans and estimates are based on information available at the time and are not guarantees of final charges. Clinical needs may change. Insurance coverage is determined by your plan; you are responsible for amounts not covered. We may assist with claims as a courtesy, but timely payment remains your responsibility.

5. Payments & Billing

Accepted payment methods are communicated by the office. Unless otherwise agreed, payment is due when services are rendered. Returned payments may incur a service charge. Promotions, if any, are subject to their own terms and may change without notice.

6. Intellectual Property

All content on the Site (text, graphics, logos, photos, videos, icons) is owned by us or our licensors and protected by applicable laws. You may use publicly available pages for personal, non-commercial purposes. Any other use requires our prior written consent.

7. Acceptable Use

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US FOR SERVICES GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE EVENT.

You agree to defend, indemnify, and hold harmless the Practice and its clinicians, employees, and agents from claims and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflicts-of-law principles.

Arbitration

Except claims suitable for small-claims court, disputes arising from these Terms or the Site will be resolved by binding, individual arbitration. You and we waive any right to a jury trial or class action. You may opt out within 30 days of first accepting these Terms by sending written notice to the contact below.

13. Changes to These Terms

We may update these Terms by posting a revised version with a new “Last updated” date. Changes take effect when posted. Continued Site use after changes constitutes acceptance.
